Judge Belinda Ang today confirmed that the hearing for assessment of damages in the lawsuit between Mr Lee Kuan Yew/Mr Lee Hsien Loong versus SDP will be held in open court.

The SDP has been pushing the courts for several days to make up its mind on whether the case will be conducted in open court or not.

The defendants have also applied for the Judge to recuse herself from hearing the matter because of the controversy over the summary judgment in 2006 where she awarded the case to the Lees without the defence counsel being present.

The Lees have applied to strike out the defendants' Affidavit Evidence-in-Chief (AEIC) as well as the supporting AEIC from former solicitor-general Mr Francis Seow, claiming that the AEICs were "scandalous and irrelevant."

The AEICs lay out the defendants' case as to why the Judge should not award the kind of damages claimed by the plaintiffs.

Mr Lee Kuan Yew attempted a similar stunt in his lawsuit against the late Mr Devan Nair in Canada. Mr Nair had countersued Mr Lee who then applied for a court order to dismiss Mr Nair's countersuit because it was "scandalous, vexatious or an abuse of process of the Court."

The Canadian judge dismissed Mr Lee's application and pointedly noted that "Lee's action is brought in a country that prides itself in allowing freedom of expression."

Mr Lee did not pursue the lawsuit. Shortly thereafter, Mr Nair passed away.

The defendants have indicated that they would like to have this striking out application by the Lees heard in open court as the matter is of public interest.

Judge Ang has indicated that she would deal with the defendants' applications for recusal and for the striking-out hearing to be in open court on Monday, 12 May itself.

LAW in Singapore means Lee Always Win.

I have no respect for PAP and any of their people since they had shown time and time again that they cannot win without resorting to unfair tactics.

Dr. Chee, please do your very best. I hope Singaporeans will have the opportunity to celebrate when Lee Kuan Yew gets a heart attack in the witness stand.

Having an open court confirmed is just superficial, we need a level ground to fight to bleed.

Of course, if Justice Pao could be invited from heaven FOC to look over the case, blood will flow. This would not be possible.

When you throw gauntlet ,and people take up the gaunlet, let the sword be sword. Why not let any evidence be evidence? Everything in life is connected whether it is relevant or irrelevant. Every one has a price.

Be fair to DR Chee, name a judge by the representing lawyers.

Somemore, be a sport, let the proceedings be watched by the millions on Local TV.

If you wish to cruch DR Chee once and for all, go further than Cul-de-sac, take up something sharper than the small hatchet. Fight DR Chee to death !

The gist is not whether Honorable Dr Chee would win or lose, it is an education singaporeans will regret not learning.

True warrior unlike yellow-belly fight to the last drop of his blood. DR Chee is one of them, do his opponents have?

Only in supposedly democratic first-world nation of S'pore, does the judge have the power to declare whether he/she will open her court to the public or not before the hearing starts! So what's the sitting space set aside for the public and the press for? I'm aware of temporarily closing the court to the public and media for sexual cases eg rape, to allow the victim to give her evidence "in camera" freely without shame or embarassment... but a defamation trial? This is ridiculous.....it should be a GIVEN for all trials and hearings in a court of law to be open to anyone to show fairness, transparency and compliance with all the laws and rules of the land. I wouldn't expect an open court in North Korea, Burma or even China but I certainly expect it here in democratic S'pore which inherited its govt and legal system from Britain! What's happening to Singapore? Are we moving forwards or backwards?
