How Judge Belinda Ang concluded that the SDP had defamed the Lees Print E-mail

Readers may be confused about the trial which is about to take place next week. The hearing is to determine the amount of damages the SDP has to pay Mr Lee Kuan Yew and Mr Lee Hsien Loong. The SDP has already been found guilty of having defamed the Lees.

This was done by Judge Belinda Ang in a summary judgment in 2006. A summary judgment meant that there was no trial where the defendants could call for witnesses, cross-examine the Lees and present our case.

The summary judgment given to the Lees was a travesty of justice because there were many areas of dispute in fact and in law.

Put simply, the Judge believed everything the Lees told her without her even hearing what the SDP had to say in its defence. Not only that, she heard the Lees' argument in her chambers in the absence of the SDP's lawyer, Mr M Ravi.

No matter how you try to cut it, no one can say that justice was served and the judgment a fair one when the Judge heard only one side of the story.

Judge Ang based her decision on the fact that the article in question by the SDP compared the running of NKF by Mr T T Durai to the running of Singapore by the PAP.

Judge Ang cited the words in the headlines of the article: "It is impossible not to notice the striking resemblance between how the NKF operated and how the PAP runs Singapore. It would take someone foolishly blind not to be concerned with how our financial reserves and CPF savings are dealt with. Here are the similarities."

And what were these similarities? The SDP article pointed out the following:

1. Mind-boggling salaries drawn by NKF staff and PAP Ministers.

2. Lack of transparency in how the NKF handled its affairs, including its finances, and in how the PAP Government handles the nation's affaits including the GIC, HDB, and CPF.

3. Defamation suits taken by Mr T T Durai against whistleblower and those taken by the PAP against the opposition.

4. Authoritarian control where the running of NKF was, according to the KPMG report, was "centred around one man (Durai)" and where the running of Singapore is also centred around one man (Mr Lee Kuan Yew).

5. The use of the media by the NKF to raise donations and by the PAP to sow its propaganda.

Based on what she read in the article, Judge Ang came to the conclusion that the "ordinary, average reader" would, like her, conclude that the SDP is accusing the Lees of "corruption, nepotism, criminal conduct, a cover up and of advancing the interests of the Lee family at the expense of the needs of Singapore."

First, how does Judge Ang, sitting in her chambers and having little contact with the "ordinary, average person" in her daily life know how such a person would think?

Second, how does she know that, for example, the Lees are not advancing the family's interests at the expense of the needs of Singapore?

Without a trial where the defendants could cross-examine the Lees and to produce "ordinary, average persons" as witnesses, how did she come to the conclusion that she did?

Does she have any inside information about how the funds are used in the GIC? Does she know how much it costs the Government to build an HDB flat? Where did she get information that our CFP savings are all intact?

Even Mr Lee Hsien Loong has said that the GIC will not reveal its assets. Without transparency how can anyone, including Judge Ang, know whether there is any financial impropriety or not.

Any opposition worth its salt would pursue the ruling party and demand transparency. The Government is obliged to tell the public all that it does with public money especially in areas such as retirement savings, public housing and national reserves.

Even the late Ong Teng Cheong, former president of Singapore, became frustrated with the Government's lack of transparency. So did former deputy prime minister Toh Chin Chye who said that he didn't believe the statistics put out by the PAP Government.

The key word is TRANSPARENCY.

It is for the Government to be transparent in all its dealings, and not for the opposition to be sued when it questions the Government integrity because there is a lack of transparency.

In other words, when the Government is not transparent - and, more importantly, refuses to be transparent - it is legitimate for the opposition to question the Government's integrity.

In the absence of verifiable information, how can anyone, least of all the country's political opposition, sit back and assume that there is absolute propriety within Government dealings?

But that's exactly what trials are: A forum where the Judge can hear all the evidence and viewpoints, including how this Government continues to remain non-transparent and unaccountable, and then come to a decision.

And yet, in 2006, Judge Belinda Ang chose to dispense with the trial and wholeheartedly believed everything the Lees told her without giving the SDP a chance to defend itself.

And so the hearing on Monday is actually a crippled trial where the SDP is only allowed to argue why the Lees should not be paid the amount of damages that they claim, when they should not even have been awarded the case in the first place.

Can anything be worse? Frighteningly, yes. Judge Ang may not even allow the plaintiffs to be cross-examined. The Lees hinted at this when their lawyer, Mr Adrian Tan of Drew & Napier, made it a point to say that the judge has discretion whether or not to allow cross-examination of the plaintiffs.


Just who is the "ordinary, average" Singaporean?

Judge Belinda Ang insists that an "ordinary, average reader" reading the SDP article would conclude that it implies that there is impropriety within Government circles. As pointed out this is debatable. What is clearer is that the ordinary, average Singaporean is, like the Singapore Democrats, also drawing parallels between the NKF and the Singapore Government.

    I am one of those that didnt know that a summary judgement had already been made. And I doubt that ordinary Singaporeans who only read the state media would even know that that there would be a hearing next week to determine the damages.

    i think someone has managed to "change/twist" the situation.

    Instead of having a trial, SDP will be there only to hear how much damage should be awarded, since SDP has already been judged guilty, as stated in this post.

    Not sure what is your next course of action, but hope SDP has one.

    I hope the LEEs are fully prepared to be made to pay back in due time. They have so much to pay back I hope they can afford to.

    Malaysian BN regime will fall followed by PAP in Singapore. The LEEs and their Kangaroo should never be let off. It is a crime to forgive them.

    I am a common, average man. I was already doubting this government and distrustful of them when I was 17, mainly due to the underhanded tactics PAP always use to win elections and double standard behaviours I keep seeing in the army. This was way, way before SDP even publish that article.

    For Lee Kuan Yew and his joker of a son, now our self-proclaimed PM, how can their reputation even be good if they don't even dare to try win an election fairly? They are not even honorable to begin with, so what reputation are we talking about in the 1st place?

    Lee Kuan Yew and Lee Hsien Loong, please stop your shameful bully and cowardice behaviours for a change. Lee Kuan Yew, you are an old man and will meet your maker soon, so please repent before it is too late. Lee Hsien Loong, retribution had came and will come again and again till you stop following your old man's way. Do some good for the people for a change.

    If the Lees are honourable leaders as they claimed, they should avail themselves to be cross-examined by the Chees. In this way, they will win more support if their arguments are convincing, after all, MM Lee is a renowned lawyer and statesman.

    I know earlier Honorable DR Chee and his sister have been ordered to pay damages to those people without a trial.

    We now could see how much the Lees are bargaining.

    Yes, you can make Dr Chee bankrupt, lose home, lose job, and crush DR chee's reputation but you cannot take away his spirit, you cannot take his dignity, you cannot take his soul, you cannot take his passion , and most of all, his love for singapore and his family and his friends.

    Nevermind how the mass media want to stain DR Chee. The media people will find their conscience one day.

    DR Chee is still young and fit among those will be at court on Monday, however hard you people try to discolor him, he will become fitter.

    In life, there is cause and effect.
    People who do wrong things cannot get away.
    You can have your rule of law, but remember that there is also law of nature.

    In my heart, i know DR Chee will shed no tears, show no sadness, show no disappointment, and face his intimidating common enemy.

    Many people can cheer and support the dark side of this court matter, but they have to know that they have responsibilities in which singapore is heading.

    I may shed tears for DR Chee, his sister, his friends because I clench my fists so tight , flushed with a bundle of adrenaline, but yet i cannot do a thing.
    But I change my mind, I should smile like DR Chee, smile the bad elements away.

    DR Chee and friends, please be strong, get bullied is better to bully people.

    Whatever the situation, my friends and I, out hearts, go out to all of you.

    I salute Dr Chee's wife standing beside Dr Chee during this trying time and continuing giving love to their children.

    We will persistently ask God and deities that if in mortal world, there is no justice, why are they still sitting in their Ivory tower in heaven?

    I wanted to cry when i write this letter, but i ask myself,if Dr Chee and friends are fighting like warriors.
    I should smile like a man, and cheer them on.

    After reading this article, one should ask him or herself, "What kind of a justice is that?"

    Aside from that, Lee Kuan Yew and Lee Hsien Loong should be very ashamed of themselves for what had happened. They are a very pathetic excuse for political leaders.

    From the LKY document I read CSJ was perpetually asking for postponement because Ravi was sick or discharged himself and looking for new lawyer to represent him. I hope CSJ is fully prepared this time round and fight the case with all his might and we are fully behind him. Do not let us down this time round with no lawyer or father and grandfather sick story.     All the best SDP, personally I have always felt that you have been the most active, constructive and worthy opposition political party in Singapore regardless of the negative portrayal your opponents and the media may constantly attempt to create of you all. As for our judicial system, I am sadden to say is that I have lost my confidence in them eons ago.

    Through my association with a good friend and SDP member I have been following the latest news regarding the unjust pursuit of damages from the SDP by the PAP to silence and destroy the party. In no way politically nor legally qualified to pass comment I can however as an 'outsider' looking in, fully appreciate the feelings of frustration trying to deal with such an impossible situation. Dr Chee and his party fight with such honour and diligence, a force to reckon with, one can only admire. Here in Australia we are fortunate to have the 'freedom of speech' you as Singaporeans have yet to experience. Lets hope the SDP will continue to fight for its people.

    Where is JUSTICE??? How can that lady judge be so careless to conclude that the SDP had defamed the Lees??

    From the entire article in The New Democrat, I can see so many similarities between NKF and PAP.. jia lat!! :shock: I say like that later the Lees is going to hunt me down.

    We shall wait and see when Lao Lee is gone.. Malaysia BN regime will fall followed by the PAP regime, we shall wait and see, very soon.

    Based on some of the comments above, it is clear that many "Average Singaporeans" do not even comprehend that the case is already lost and its all about how much money the Leees get. So much for the judge coming to her decision based on what the average Singaporeans comprehends based on the article, if the average Singaporeans had read the article in the first place. The Leees must defend their honour and intregrity , in Singapore. Well it not their honour and intergrity worth defending else where?
