Singapore Democrats

The following is an exchange between Dr Chee Soon Juan and Mr Lee Kuan Yew during cross-examination on 27 May 08. Note how Mr Lee was unable to answer Dr Chee at the beginning of the session. Mr Lee appeared vulnerable at certain moments.

This was never revealed by the mainstream press. Through clever editing, the Minister Mentor is always portrayed to possess a sharp-tongue and quick-wit. This exchange explodes the myth. It will change the way you see Mr Lee and the whole PAP machinery. Shorn off their media make-up they look and perform very ordinarily.

Still, his was a better performance than Lee junior who seemed nervous and stiff. It was clear that Hsien Loong could not expound the ideas that his father could. This is understandable as many of the younger generation of leaders are technocrats with few original ideas of their own.

Also, the state media went out of its way to describe Dr Chee and Ms Chee as incompetent and rude. The transcript, taken from the audio-recording, will show this to be wholly false.

CSJ:  Mr Lee, we get to meet at last.

LKY:  (pause)...Sorry?

CSJ:  We get to meet at last.

LKY:  I thought we've met many other times across election rallies.

CSJ:  Your memory fails you. I've never met you before and you know why? Because you keep avoiding me. (Mr Lee laughs) Well, we have this opportunity right now. Let me ask you this question. You gave an interview saying: "If you defame us, and if I'm involved, I go to the the witness box and you can question me not only on the particular defamation issue, but on all issues in my life." Do you stand by your words?

LKY:  I do.

CSJ:  Good. In the course of the cross-examination, will you then answer questions not just on this particular defamation issue, but on all issues in your life -- and I don't mean your personal life, I mean your political life? Will you stand by that?

LKY:  Your Honour, we appeared in court when the issue was whether or not the summary judgment was proper. That was the time to challenge --

CSJ:  Mr Lee, that was not my question.

Judge:  Allow the witness to answer. Mr Lee, please go on.

LKY:  I have to answer. I'm a lawyer. I no longer practice the law. I know your purpose. You dodged that occasion and you're trying -- Dr Chee is trying today when the issue is the question of quantum of damages, it's not liability. I'm here to answer questions relating to the quantum of damages.

CSJ:  Thank you. Then why is it that you say you will go to the witness box --

LKY:  I have already explained that, Your Honour --

CSJ:  -- and answer questions not just particular to this defamation issue but on all issues of your life. Now tell me, are those just brave words meant for public consumption and in this situation right now you're turning tail and running?

LKY:  Ha ha ha, no Your Honour --

CSJ:  Good. Then you won't mind me asking you why is it that you make this application to cut short your cross-examination precisely when you walk in at noon and say that you have to be stopped in the cross-examination by 2:15 giving me. the defence, only two hours and fifteen minutes, and then insisting that all of us can't go for lunch. And on top of that refusing to tell the court what this "important matter" you have this afternoon is.

LKY:  That's...Your Honour...(pause)

CSJ:  I'm lost for words too as I think you are right now.

LKY:  ...(pause; Mr Lee was seen opening his mouth to answer but no words came out)

CSJ:  Go ahead, Mr Lee.

LKY:  ...(pause)

CSJ:  No answer? That settles the question then.

LKY:  Ha ha ha.

Judge: Dr Chee!

CSJ: Fine, let Mr Lee continue. I'm just waiting. He's probably lost for words because he doesn't quite know what to say at this stage.

Judge: If you keep interrupting the witness...Yes, Mr Lee.

LKY: ...(even longer pause)
CSJ: Please don't run down the clock. I've only got a few minutes.

At this stage, Mr Davinder Singh jumped in to bail out Mr Lee.

Singh: What is the question? Dr Chee has made so many points in his speech. He has already been told that the time to cross-examine the witness was during the summary judgment. If he had leave to defend. All issues would have been open for Dr Chee to have questioned him. The witness said that for Dr Chee to have questioned him. The witness said that Dr Chee had dodged that application and is now trying through the back door to introduce impermissible material. The witness said he is here as he said to answer questions on quantum. Dr Chee should really get on with the issue of quantum.

CSJ: Let me ask the question again. Mr Lee, you have said that you are here to answer these questions and I say that in that case why did you make an application to, halfway through the session, want the court to cut short this entire hearing. Now, I remind you that we have got until the end of tomorow, the end of tomorrow. So we have one-and-a-half days. But you insist that we have to finish by 2:15 for you to attend to some matters that you won't even reveal to the court. Now I ask you now does this sound like somebody who's willing to come to court and meet and resolve the issues?

LKY: Your Honour, I had a message from one of my counsel's aides to say that I should be in court by here 2 o'clock - by 12 o'clock because Your Honour has imposed a guillotine that the cross-examination of the prime minister would end at twelve. So I turn up at twelve. I was told that the guillotine allowed - had already been late he would be given 2 hours. I suggest - I asked my counsel to request the court to finish this two hours so that I can attend to some important matters. There's no disadvantage to anybody to be sitting here and finishing off this cross-examination within the two hours. What I do not want to be a party to is a deliberate abuse of the process, of the proceedings of the court by delaying tactics.

CSJ: So, Mr Lee --

LKY: And by asking irrelevant questions, Dr Chee is running out the gullotine. At the end of the day, we've had this confrontation face to face have you thrown any dirt, have you dug up any scandal? Are you still saying as you've said before that this government is run like the NKF?

CSJ: Now, Mr Lee, let me try to --

LKY: No, we are here because you have said that --

CSJ: Mr Lee, I'm going to ask you this question and I wish you'd just stick to the questions that I pose to you. I'm asking you why did you come to court --

LKY: Because I was asked --

CSJ: Let me rephrase my question. Are you telling the court that you had nothing to do with the curtailment of this entire process?

Singh: Your Honour, I made the application this morning and Your Honour would remembers that I said I was very troubled with what the Chees did yesterday and that it was quite apparent that they had nothing to ask which was of any relevance and that unfortunately or otherwise has been proven in this exchange. And I said, Your Honour, that the whole purpose of the cross-examination was to insult, annoy and to scandalise and that's also been proven true. For that reason, I had asked that there be a guillotine. Your Honour had full powers to control the proceedings. The order has already been made and I don't see why this witness should be asked to explain something that was the subject of my application and Your Honour's order.

CSJ: Do you see the game that's being played here, Mr Lee? Do you see how you are beginning to hide behind your counsel and then claim, "Look, I'm willing to confront them. It's my counsel." Now I'm going to ask you a very simple question: Right here, right now, tell Mr Davnder Singh "Don't interrupt. I will answer these questions as they are put to me right now."

LKY: Heh-heh. Your Honour, I've briefed counsel, I've always found it's never wise to be my own lawyer in my own case. I know that some perople believe that they can do otherwise, and I'm quite sure that Dr Chee is making a very great impression on all the reporters in this court of how he is better than Mr Ravi --

CSJ: I think you meant Mr Singh.

LKY: I believe Mr Singh is better qualified to deal with the legalities of this case.

CSJ: Well, I should hope so with all the training that he's got. Now, coming back to my question, Mr Lee, is your answer no, that you wll not tell Mr Singh: "Stay out of this. Let me answer my question because --

LKY: I --

CSJ: Let me finish my question -- because you have said -- and I repeat to you -- that you will answer not only questions about the "particular defamation issue, but on all issues in my life."

LKY: Yes...as long as that was what was an issue and that was the, it was an issue in the summary judgement was appealed against. [Note how garbled the answer is.] And we turned up for the hearing but you dodged the hearing.

CSJ: Mr Lee, you are not unintelligent.

LKY: Thank you.

CSJ: You knew precisely what you meant and what you mean is: "Come and ask me all these questions that doesn't pertain to this defamation suit and I will answer you because my entire standing, inlcuding the standing of this government, is at stake." Is that not correct?

LKY: I think, Dr Chee, we'll cut short this proceeding to become more relevant.

    Wow, without the media makeup, LKY can hardly speak or hold an argument. He just paused and paused and paused....

    Perhaps he is getting senile, and age is catching up with him.

    This is the kind of information that the media does not give. Any unbiased media would have televised this on national TV, or at least have the transcript available on the newspaper.

    However, now with the internet, nothing could be hidden.
    SDP, you should have alternative plans should the government try to shut down your website or domain!!! This kind of information should go down for posterity. There should be multiple website worldwide that keep archive of the transcript between LEE and CHEE. This is only a partial transcript. A full transcript would be invaluable.

    I will look forward to reading your website for more transcript. You are whetting my apetite by releasing this in parts :)

    BTW, has anyone recorded an audio transcript or a video? If so, can it be put on Youtube?

  • Lee - Without his script-writers, MM cannot talk
    What do you think LKY meant when he said "I am a lawyer. I no longer practice the law".

    The truth is that he is trying to create an excuse as to why he is at a lost of words... and having all the long pauses. Note that he have script writers that write all his speeches, and he just read them (like he wrote them). Now in an actual court of law, it become apparent real soon that he is just an ordinary person, perhaps senile with age and unable to speak reasonably. He has to depend on a train lawyer like Singh to be his mouthpiece.

    This transcript have just explode the myth ... force him in the open without hiding behind script writers, and appearing to be smart...

    I think Yew underestimated Dr Chee.

    He thought he could just walked in and happily argued about the quantum.
    Little did he knows he was a facing a real gentleman.

    Talk about why Yew reluctant to stay low.
    People everywhere in the coffeeshops, Pubs, geylang brothels, you name it, are gossiping that Ah Yew is the gatekeeper of the country's reserves.

    While stinkapore( now they call singchou)is boasting about the 300 billion, the local lot are sweating at the queue to pump cheaper petrol and many locals are paying through their nose for basic shelters, essential items, etc.
    You call this 300 billion an unprecendented or never- before -seen achievement?

    So what is 300 billion ? Big deal ?
    Who is getting all the benefits may we ask, may you answer honestly?
    What is the future for our generations to come, more good years, sorry, more golden periods or you die your biz???

    Of course, everything is connected when it comes to reputation.
    If the golden tap was not relevant, how the people know the Old NKF's integrity had gone to the dogs.

    Look around you at the MRT, at malls,and at HDB flats. It's not about Sinkapore anymore, anyway, sinkapore does not belong to local sinkaporeans no more, and the local lot is already diluted. I think the final phase to make local sinkaporeans a minority is complete.
    A crave for monetary power at all costs is on the way to destroy the island.
    New citizens and foreigners have motherlands to fall back whilst the locals are the pitiful lot. They vote PAP at their own peril.

    When Ah Yew kicks the aluminium can one day(he dont deserve a bucket), i guess many rich officials under him would emigrate for good.

    In the end, sinkapore is a tragic story.

    May God help us to find back our singaporean singapore once again.

    When a plaintiff has to pause at such a simple question, it shows that he has to think of how to wriggle out of the fact.

    Having to wriggle out of such simple and direct question shows that the plaintiff cannot stand up to scrutiny and therefore, can be seen as less than credible. Integrity = minus zero!

    TT Durai chose to remain silent when questioned in one of his trials. That was taken as an admission of guilt.

    First of all, what really the questions? Can anyone elaborate? If Chee and LKY have to meet up to discuss about the damage, how come Chee have to bring up questions like "whether LKY is behind the curtailment of this entire process", "whether the application is cut-short".

    If SDP can't afford to ask proper questions, do not waste time. Even during time like this, SDP cannot concentrate on the issue they are facing, moreover running the country.

    Last Friday, Chee Soon Juan wanted to rope in veteran opposition leader JB Jeyaretnam to represent him.

    But Mr Jeyaretnam told the court on Monday that he was not ready to take on the case as he had just received the court documents. He asked the court to proceed with the hearing.

    Fellow citizens - Youtube is the most popular medium and can reach out to everybody.

    It does not matter if the recording is audio or video. If audio, it can still play in Youtube if you just use the audio as a soundtrack to some images. A very simple image would be to use the old monster's face. Or you can also instead use a lovely picture of the Botanical Gardens.

The truth of the matter is he is just an ordinary old man (gangster-leader) and also misuse and sometime abuse his power for his own political gain.

    Singapore is like a 'big-family' to us. With Dr Chee Soon Juan and JB Jeyaratnam as senior brothers and the rest of the Singaporeans as our brothers and sisters. In a family context, do we do injustice and unfairness to our fellow siblings just because someone got S$400 billions?

    Can someone put the audio on Youtube please. Or...even as a last resort, have show the transcript on Youtube and have someone read it (kind of lame). However, since Chees are going to jail for 12 and 10 days, this should be on youtube asap, so that people can remember what really happen.

    Is anyone afraid of putting it on youtube. If you are not afraid to go to jail for the right cause, then Youtube is the right cause to disseminate the truth.

    The damage is not in this court; the damage is with the standing of this Government, with its own people. And that’s what this is all about.
    And, therefore, when I appear as a plaintiff, I am really representing the whole leadership of the PAP.

    Ravi: I see. So you have come to represent, to protect the reputation of the PAP, and the Government in this court?

    LKY: I have said the law requires us to sue in our individual capacities, but in actual fact, the impact of any adverse outcome is on the whole Government and the PAP.

    Ravi: So you have come to the court to defend the entire Government and the PAP; am I correct?

    LKY: I thought counsel understood English.

    Ravi: No, Mr Lee. I don’t understand Greek.

    My first stint in Singapore was for 4 years from 2002, i have been back for a year and leave at the end of the month again. I have been following this case because of the lack of interest and apathy i see from my work collegues. Unfortuneatly this is endemic in Singapore. My role like many other Foriegn talents has been to push the envelope and bring about change that unfortuneatly most locals fear to tread for obvious reasons. Although questioning authority, systems and processes has its inheriant problems, like punishment, often apathy, resistance (Oh Sounds like Transformation) Eg seriously hard work. The benefits if done well make for a stronger country. Could MM Lee really be looking for a serious street tough oh and refinely educated adversary to take care of this country Singapore???...

    Mr Chee doesnt seems to be trying to prove his guts to "western symphatisers".

    Even if he does, there is nothing much that "foreign symphatisers" could do to help him. Do you think that by a mere speech would drive the entire US Marine to bring down an undemocratic government?

    Hope you get it clear that he is defending the values in which every people, especially Singaporean deserved to have.

    I dont know and I have never met Mr Chee. Maybe I dislike him for his slightly crude approach to bring forward his ideas. But nonetheless, isnt there truth in what he says ?

His Counsel was not even prepared for this debacle and unable or too intimidated to rise to the occassion. Where is that brave lion than confront Mr. Durai? I certainly looked foward to more wayang!

    One, I'm sure, NOBODY KNOWS: Temasek MD-ship (along with XXX-ships of the various GLCs in that umbrella group), GIC Chairmanship, Raffles hospital whatever-ships, Sheng Siong 9sure to have, what, finger-in-every-pie policy mah).

    And Forbes - Steve and Dad Malcolm were buddies, yes?     WOW!! I didn't know that. That was an interesting articles. I was away from Singapore for so long and now I am back. Glad to see there is some information sharing on SDP. Have lost in touch with Singapore for the past 5 years and didn't know everything has changed so much. But I do have a feeling that sometimes PAP is trying to distort the truth and also brainwashing Singaporean's mindset overtime slowly and slowly. When I have read this insight articles I have came to realise that there are something outta there in cyberspace sometimes can be reliable or not so reliable at all. Everyone has a secret. Who doesn't anyways.

    I am no PAP Hater, nor do I think they are perfect. And I do not believe one has to paint the opponent as evil, or resort to pointless lines of questioning in the court of law. It merely gives the opponent fodder for mockery. I do not understand why the SDP believes that posting this transcript is of any advantage to the party's causes. The line of questioning is pointless and goes around in circles, completely irrelevant to the case being discussed. This is the kind of bait that a fool easily takes only to be mocked by his opponents. This transcript only proves the PAP's constantly reinforced points about the pointlessness of Dr Chee's arguments...it does the SDP more harm than good in my opinion.
