Singapore Democrats

Confusion reigned at the Subordinate Courts today in the on-going prosecution of Mr Gopalan Nair. Blogger Mr Nair was arrested and charged for posting an article criticising Singapore's judcial system.

No sooner had Mr Nair's case come up for mention at Court 26 at 9.00 am that it had to be stood down again for two hours. This was because the prosecution could not frame the charge properly.

When it was finally able to make up its mind, it surprised everyone by amending the charge to one of Mr Nair "insulting" High Court Judge Belinda Ang in his blog post. The charge of Mr Nair sending an email to Judge Ang was dropped.

Mr Nair has also been ordered by the Court to report to the Cantonment police station at 9.00 am every day until the case comes up for further mention at the same court on 14 July. This is said to be for the purpose of "investigating into further offences".

As on previous occasions, there were two US diplomats witnessing the proceedings at the court today.

According to a lawyer present in the courtroom, the authorities are playing a "game of harassment" with Mr Nair to test his endurance and to wear him out.

Prior to today, there were several charges against Mr Nair, including one of sending emails to the Attorney-General, the Solicitor-General and Judge Belinda Ang. These charges have been dropped and the prosecution is now sticking to two charges: Sending an insulting email to Judge Lai Siu Chiu on 17 March 2006 and "insulting" Judge Belinda Ang in his blog post.

With the latest amendment, Mr Nair will now be tried in High Court. This is because the charges, classified under Penal Code 228 could only be tried at the lower court if both the prosecution and the defence give their consent.

While the prosecution is keen for the trials to take place at the Subordinate Courts, the defence is insisting that they be heard at the High Court so that the final judgment could find its way into legal publications.

An observer said that from the way the charges are being dropped and new ones preferred, it looks like even the latest charges wouldn't be the final.

Mr Nair was arrested by the police on 31 May and kept in the police lockup for five days before being produced in court and released on bail. His American passport has been impounded.

Mr Nair, himself a practising counsel in the US, is represented by Mr Chia Ti Lik.

  • Chew - World class, or bottom of the barrel?
    "World class" prosecution can't even make up their mind on the charges after so long? It just shows that the tax payers' money are wasted on such a bunch of nincompoops.

    And for ordering Gopalan Nair to report daily at 9am till 14th July, that is one whole month.

    1) Is the state going to compensate Gopalan Nair for his time, accomodation, travel expenses during this entire period? Are there any safeguards to prevent the state and judiciary from abusing their powers to repeat this loop indefinitely? Is Gopalan Nair entitled to off days, Sundays, public holidays, MCs, etc.?

    2) Is Gopalan Nair innocent until proven guilty, or had he already been deemed guilty without trial? Why all these hassles and burdens on Gopalan Nair instead of the prosecution if our rule of law belongs to the former?

    3) Is the court a neutral party in deciding on the case between the prosecution and the accused? If it is, then why is it taking the side of the prosecution to penalize Gopalan Nair through such inconveniences?

    Answers anyone? SPH? PAP? SPF?

    Dear Nair,
    I came aross your blog thru an email from a friend. Since then, I have been concern for your status in Singapore and have been updating your news thru SDP.

    Am proud of you and Dr Chee's courage to fight for freedom and free speech. Our SG president and prime minister should be glad to have such courageous fighters like both of you. Singapore needs people like you. I felt a great sense of loss for Singapore when talents like Nair denounced his citizenship. But what can we do?

    As for me, I have been living and working in the gulf. Have not been visiting my homeland for a quite a while. I do not intent to return nor have I have any future plans for my country. Why?... ... We are a treat to their political system... ...simply coz, we have a mind of our own.

    This is a big loss for Singapore and its future generation. But honestly speaking, who cares? The govt is only interested in its people paying taxes and more taxes... ... till we die.

    I hope you will be strong and take courage. Hopefully, everything will go well and as for your safety is concern, please do not return to Singapore ever again.

    Are they able to charge an american citizen on that for insulting a judge? Being american he abides by the US laws doesn't he? And critising the judiciary is not against the law in US. Kangaroo Judge Beli....i mean the most honorable Judge Belinda Ang may be able to launch a personal libel suit if she so wishes but definitely not a criminal charge against Nair. The fact that the prosecution could not make up their mind shows they are desperate to charge Nair on any charges they can think of. They probably found out that the email to Belinda Ang is bogus and i don't believe the email to Lai Sui Chui still existed after all these years, all trails will have gone cold by now. They probably stick with the charge because Nair mentioned in his latest blog that he couldn't remember whether he send it or not back in 2006. Nair should get his future postings in his blog vetted by his lawyer before publishing them while the case is not settled yet. All the best to you Nair.
  • JT - Prosecute Lee Kuan Yew for Treason
    I believe this is the most critical issue in Singapore politics hence I am re-posting this in a more prominent position on this web site. The question is who will or can start this lawsuite? A question for lawyers.

    Lee Kuan Yew should be prosecuted for TREASON against Singapore for subverting the Democractic system put in place by the British and used by Lee Kuan Yew to come to power. Lee should then have to suffer the consequences as set out by current law for treason in Singapore.

    If the Attorney General of Singapore truly stood up for law he would act against Lee and his son who have turned Singapore into a dictatorship, the fact that the Attorney General does not prosecute Lee makes him guilty of not upholding the Democratic Constitution of Singapore.

    Lee Kuan Yew subverted a functional democratic system with a strong opposition that actually could win an election if:

    1) Gerrymandering of ridings and vote counting irregularities (as has been claimed by many sources) were not practiced by Lee and the People's Action Party.

    2) The public was not threatened with withdrawal of financial support for their electoral riding as is done under the PAP's rule

    3) Strong opposition leaders that made serious attempts to win a majority election for their party were not jailed and or bankrupted as Lee was not back in the 1950's when he came to power under the original British Parliamentary Democratic system.

    4) The Singapore Media was not owned and controlled by the Singapore People's Action Party majority government - essentially making the main Singapore media a branch of the People's Action Party.

    Any real democratic court in the world would rule that Lee Kuan Yew is a dictator that has demolished the original British Democratic system that was in place when he used it to attain power in 1959.

    Singapore Elections Act states:

    Undue influence
    59. Every person who —

    (a) directly or indirectly, by himself or by any other person on his behalf, makes use of or threatens to make use of any force, violence or restraint, or inflicts or threatens to inflict, by himself or by any other person, any temporal or spiritual injury, damage, harm or loss upon or against any person in order to induce or compel that person to vote or refrain from voting, or on account of that person having voted or refrained from voting at any election; or

    (b) by abduction, duress or any fraudulent device or contrivance, impedes or prevents the free exercise of the franchise of any elector or voter, or thereby compels, induces or prevails upon any elector or voter either to vote or refrain from voting at any election, shall be guilty of the offence of undue influence.

    Lee Kuan Yew and his Prime Minister Son Lee Hsien Loong are guilty of using Undue Influence in the Singapore Parliamentary Elections Act by threatening to withhold money to constituents who vote in an opposition politician and also by bankrupting and or imprisoning Singapore political leaders who make a serious attempt at winning a majority of seats from an election for members of Singapore's Parliament.

    So ... the Gov made the lighting arrest but still cannot figure out the charges after 5 days of non-bailable detention and more than 2 weeks of investigation?

    To me, this is just "further evidence" that the whole case was highly unusual.

    Normally, police gathers evidence before they make an arrest. In this case, they are doing it the other way round: Arrest first, gather evidence later.

    the government is making themselves look pretty bad at this point. In fact, the government is making Singaporeans look pretty bad as well. What I mean by this is that in order to save face for one or two people, the government will sacrifice the face of a nation... how shameful.

    the government lost, it's over. as I've said earlier they could've simply deported GN and ban him from ever entering singapore again, but nope, they had to try and prove a point, and they did. the point they proved is that the face of a few matters more than the face of a nation. i thought in singapore nation comes before the individual???and with that mindset, every singaporean who is not breaking bread with the elite had better now realise that they will never be invited to the head dinner table.

    regarding first world countries, perhaps only in singapore does the child's nursery rhyme change from "sticks and stones may break my bones but names will never hurt me" to an adult belief that "sticks and stones will break my bones and defamations and insults will jail and bankrupt you."

    i'm glad dr. chee does not sue the reporters from straits times for using the media to allegedly smear him by making a medical diagnosis. do not fall into that trap. in my opinion "someone" wants dr. chee to bring up a lawsuit knowing dr. chee needs money so that they can then turn and question dr. chee's integrity and say "look, dr. chee makes a big stink about daddy junior suing and then dr. chee turns and does the same." in my opinion, dr. chee is on an entirely different and higher level than the status quo.

    i met a 60 year old man, singaporean, the other day. he told me he went to california earlier this year. he said when he stepped off the plane, a heavy feeling was lifted. he said for the first time in all his life he knew what being free was. he also told me he will never read the straits times, or watch channel news asia or mediacorp news ever again. he said when he watches or reads local media, it is like being handcuffed. he said the only thing is that it is not his hands that are handcuffed, he said it is his mind and his heart that is handcuffed and in prison.

    I believe that to the PAP Mr Gopolan Nair is a terrorist or represents a terrorist cause, thus their harsh treatment of him.

    Similarly in Australia under the previous PM Howard, a doctor (wikipedia: Haneef) who was a relative of the London bombers was falsely accused based on flimsy evidence and hence the government's case against him collapsed.

    However in Singapore's case, it would seem that dissent + criticism = terrorism.

    I can never understand the US's role in Singapore. They are supposed to spread democracy around the world but conveniently closes their eyes to an island nation which serves as a navy base. Yet this island nation's arrogant government from time to time has insulted or belittled America and its citizens in the local "media". Maybe the USA's debt has made it far more pliable to dictatorships.

    In court today, the prosecution took another U turn. Call it flip flopping if you like- First they charged me with sending an Email to Judge Belinda Ang, alleging that I insulted her. Second they charged me with sending an Email to Judge Lai Sui Chu more than 2 years ago alleging the same. Third they withdrew all charges and charged me under the Sedition Act of Singapore for what I had written on my blog of May 29, 2008. Fourth, they withdrew the Sedition charge and wanted to proceed on the earlier Email charges.

    Today in court there was a further U Turn. Now they are no longer proceeding with the Email charge to Judge Belinda Ang or the Sedition charge and have instead charged me with having insulted Judge Belinda Ang on May 29, 2008

    First there were two emails that were sent, and now insulting the primadonas queen of hearts who wants to smell some PAP fart can't even fathom that a person can pretty much want to say whatever they want in his/her blog, and if that has been classified as an intent for libel or defamation..I think Ah Pek & his gang are really out of sequence this time.

    Now coming back to what Bernard Chan had said..though it's hard pill to swallow, but in the case of Mr. Nair, I think it's very clear that Ah Pek is going to answer a heck of lot of questions this time around, and it's the dragging that makes one to loose focus and become so agitated, and that's what Ah Pek and his gang are teaming up against Mr. Nair and everyone that are standing up to him.

    The only way for the system to collapse is to see if any PAP ball lickers can have any sort of remorse or giving up on the PAP regime, and in order for that to happen.. is to keep on telling the truth and never stop. The Malay and Indian along with majority Chinese MP's must sway away from the PAP ball lickers, and move on to a platform that true democracy must survive in Singapore, otherwise Ah Pek with his bleeding hearts is seeing off the hoardes of Singaporean that are leaving in an alarming rate.

    Once again SDP is the only means to achieve democratic objectives, and Ah Pek is doing his very best to make sure his regime will be in Singapore for ever and ever, and by all means don't stop the reformation struggle to obtain true democracy in Singapore. Again, long live SDP.

    Be careful, for the sake of the creditability of our judiciary, and our nation! Be wise and use your discretion.

    It may be so that Gopalan has broken the law, in those ways you want to prosecute him for.

    But the coincidence of these frantic but seemingly faltering attempts to get him, with the nature of his blog postings, is wont to fan suspicion over the independence of our judiciary.

    His postings were a personal challenge to Lee Kuan Yew to sue him. So he implies that what he says about the recent court proceedings are true and he can prove this in a court of justice.

    So, should Lee not sue, then (since suing has been his method of upholding government's integrity) might he not leave room for suspicion in the public's mind that he has no answer to Gopalan?

    And instead of Lee's suing, we get this frenzy of arrest and detention by the state even before it was decided what Act he had infringed. Then, first this charge, then it was dropped, and replaced, etc. And, suddenly and coincidentially, what he did two years ago has become such a vital issue!

    How is the public and the world to interpret all this?

    We say it's so crucial to uphold the reputation of independence of our judiciary. So we say prosecuting Gopalan is precisely to protect the courts' reputation.

    But then, is it wise to coincide so exactly this prosecuting of Gopalan with his personal affront of Lee Kuan Yew on his website?

    Already, the independence of our judiciary has been suspected because our legal service is only another branch of government. And Lee has been quoted by none other than a former President to have said that "we control every branch of state administration. We will make him (Jeyaratnam, who had just won a by-election against the PAP) crawl and beg for mercy".

    Now, in such a context of suspicion, is it wise of the attorney general's office to prosecute Gopalan immediately after his affront of Lee? Wouldn't people be likely to read it as Lee's deciding not to sue, but to make use of the juduciary to punish him instead? And wouldn't that undermine the public's perception regarding the independence of our judiciary?

    We must bear in mind that the creditability of our judiciary must not only be a fact, but must be perceived to be so, in order to be effective.

    So, let's not forget the larger picture of things, and risk losing a war in wanting to win battle!

    GN challenged lee kuan yew and lee kuan yew has not answered the call.

    do not forget this.

    you see, this is the news that is not being reported. charges they bring up, that's one thing. i care more about the one charge that is missing, an lky defamation suit. this is the news that a real journalist would ask and question. a real journalist would be asking lky, "you sued chee and others, GN calls you a dictator repeatedly and challenges you after you mentioned you would go after people in cyberspace if you knew who they were. however, you have not responded, why?"

    There are inventing and fabricating the cases. The pap government is using this to stirr up the racial sentiments in Chinese Singaporeans in a dangerous attempts to win back their supports after the fiasco of Mas Selamat Great Escape. This is just like Lee Kuan Yew accusing Tang Liang Hong of being a Chinese chauvinist at the height of the very close contest in Cheng San.The pap government is playing with racist fire.

  • TK - Here's why GN is framed!!!
    It become very apparent to any logical reader that GN has been framed.
    Here's the reason.

    1. They (PAP/Police) first charged GN for sending emails to Belinda. He was not allowed bail because they initally says he was a threat.
    2. Was this true?? The charges keep getting changed. In a true police investigation, THE FOCUS IS ON THE ISSUE AND NOT ON THE PERSON.
    3. The ISSUE is the emails and the threat to Belinda. If the emails that the police produce to show GN are true emails, the police should be investigating those. If they realised that GN did not send the emails, they should be further investigating the real person who sends the email. That is how a normal police investigation goes (I am probably watching too many episodes of CSI). They should try to catch the culprit of the emails... ie the ISSUE at hand.
    4. The PERSON is GN. If they keep changing the ISSUE, then they are trying to pin the fault to a person. There are no real ISSUES. It's the PERSON that they are after, and trying to FRAME the PERSON. The ISSUES are just excuses!!!!

    After reading the various news reports, and Gopalan's side of the story, it has become very obvious that the Singapore POLICE is trying to FRAME GN. The ISSUES keep changing, and they are not trying to investigate the real culprit of the ISSUES. They are just tring to PIN the PERSON!!!

    I agree with the post by TK above (Tue, 17 Jun 2008 9:43 am).

    The real offender is the person who sends insulting emails to the judge. It is possible to trace emails. If they dropped that charge against Nair, it means they know he did not send the email. If they do not proceed to name the person who sent that email, it means the sender is a PAP supporter.

    Now, remember the offender is the person who sent that email. Why are they not charging the sender??? He's the one who committed the offence!

    Mystery shrouds Tamilian’s death in Singapore prison

    THANJAVUR: The hapless parents of Katturaja (32) of Nemmeli North in Orathanadu taluk are crying foul over the “mysterious" death of their son in a Singapore prison.

    According to sources, Katturaja, son of R Govindaraju, went to Singapore at the age of 21, through a travel agent on a tourist visa but overstayed there for 11 years as he could not get any job there.

    Katturaja was arrested by Singapore police just three months ago on the charge of “overstay without valid permit in the country” and was lodged in prison.

    An inmate of the prison, hailing from Movur village in Thanjavur district who rang up to Govindaraju, informed him of the shocking news that Katturaja died in prison on May 22. When Govindaraju contacted the Indian Embassy in Singapore, the officials also confirmed the information.

    However, there was no proper communication sent to the parents either by the Singapore Government or the Indian Embassy in Singapore about the death of Katturaja, triggering suspicion.

    “Despite having our proper postal address, the prison authorities have not bothered to keep us informed about his death. There has been no proper communication either by the prison authorities or the embassy. We came to learn about his death only through the call made by one of the inmates”, Govindaraju told this website's newspaper.

    Govindaraju also expressed apprehension that his son might have been murdered in the prison. “My son, who spoke to me over phone three months ago, never complained of ill-health even once. So, it gives room for suspicion that he might have been murdered”, Govindaraju added.

    Katturaja’s parents Govindaraju and Prabavathi, accompanied by his three sisters, Kalpana, Kalairani and Karpagam, who gave a representation to the district administration on Tuesday, demanded that arrangements be made for bringing his body to his native place to enable them to have a last glimpse on the body.

    When contacted, Collector’s PA (General) D P Raju said Govindaraju’s representation would be sent to the government and steps would be taken to bring the body. (END)


    Do you see how things work??? if this story is true and this guy died and people involved tried to keep it hush, mas selamat and this tamil's story raises questions again!!! this is why SINGAPOREANS MUST NOT "MOVE ON" AND DEMAND CREDIBLE ANSWERS WHILE HOLDING PEOPLE ACCOUNTABLE!!!

    nothing is reported (as far as I know) locally and citizens are kept in the dark. accountability does not mean the ability to count millions in salary. accountability means being responsible.

    The simple reason is because Singapore's judiciary is a hypocritical as Lee Kuan Yew. An accused is guilty until proven innocent, not the other way around like they always claim.

    Interesting... like you, I get an impression too, that the establishment would had nothing to be embarrassed about if everything was done aboveboard with no skeletons in the closet.

    The matters that really count are the existence of these hidden skeletons, if any. Surely the establishment wouldn't be bothered if there ain't any to be found. No? That is what really counts, isn't it?

    Normally, the police, by the penal code, distinguishes between "seizable" and "non-seizable offences. The latter, and only the latter, are those for which offenders can be arrested and detained.

    The reasons are obvious. Only when the detention of suspected offenders is necessary to protect the public or other persons (say where "grievious hurt" to others is threatened in "assault" cases), or when the nature of the offence is serious and bail is no incentive not to escape (such as capital offences), would it be lawful, serving the interest of justice, to "seize" and detain the suspect.

    Even then, the detention should not be such as to punish, for it is not imprisonment yet.

    Now, was Gopalan's arrest and being held several days and nights justifiable by the spirit of the law, as indicated above?

    Was he a threat to Judge Ang such as to need physically detaining him? And that he is not likely to escape is acknowledged in his subsequent release on bail. Was his detention then unlawful and unjust?

    Worse, according to his own account of his treatment under detention, it was worse than imprisonment. 24 hours bright lights, cold concrete floor with only a mat, no blanket - only a plastic sheet and only after hs shivered and asked! All that contuously for some three days and nights, initially planned for five!

    All this done by officers of the state in the name of the integrity and justness of the judiciary?

    Meanwhile, they prepare for the next National Day frenzy at which all are to clench their fist and thumb their chest to pledge, even in song, to build a democratic soceity "based on justice and equality"?

    It's simple. Consider 2 points :

    a) Look at the colour of Mr Nair's skin; compare to Michael Fay's white skin.

    b) Bush will step down after this current 2nd term of presidency, so even if he pleases the US public he cannot continue to a 3rd term. So why bother to step into this issue ?

    Mr Nair is already very lucky to have 2 US diplomats to attend his hearing. Don't expect US President Bush to take any interest since he is stepping down soon.

    To deduct from relevant ministries who did not 'perform' and made trips to slumberland whilst mismanagement took place eg: Ministry of Health for their lack of supervision over SARs and NKF; regulators who were suspicious, but did not follow through with their responsibility robustly, even if it had caused unpleasantness and unhappiness!

    Temasek Holdings - for their lack of entreprenuial talented acumen, causing the loss of millions of public invested stake/monies???
