Singapore Democrats

The courtroom was packed with the accused persons as well as members of the public who had turned up to watch the trial of 18 persons charged for taking part in a protest on 15 Mar 08.

The morning started off with Mr Ng E-jay pleading guilty to the charge of taking part in an assembly outside Parliament House. The second charge of participating in a procession was taken into consideration. Mr Ng was subsequently fined $600.

The defendants then insisted that they be given copies of the video footage that the prosecution had said that it was going to introduce as part of the evidence.

Mr Chia Ti Lik informed the court that he had written to the AG's Chambers (AGC) that the defendants be allowed to view the police DVD.This was back in 8 Sep 08.

Dr Chee Soon Juan added that on 7 Oct 08, he had reminded the prosecution at a pre-trial conference (PTC) about the video. The PTC judge had asked the AGC to expedite matters and release the video to the defendants.

Just three days before the trial, the prosecution called a few of the defendants that they could view the tapes at the Police Cantonment Complex. Why the dragging of feet? And why were not all the defendants informed?

When pressed today in court Deputy Public Prosecutor Mr Isaac Tan told the court that the prosecution had not made up its mind whether it would use the video as evidence!

The hearing was then stood down for the AGC to make up its mind about the video and to process Mr Ng E-jay's fine.

Ham & cheese omelette and potato saladLunch break at the parkWhen the hearing resumed at 3:30 pm, the court clerk spent the next 1 hour and 45 minutes reading out the charges to each of the defendants.

When it came to Mr Jufrie Mahmood, the officer asked him what language Mr Jufrie wanted the charge to be read in.

"English," the veteran oppositionist replied.

After the charges were read out, the clerk asked him: "Do you understand the charge?"

"I understand what was read out to me," Mr Jufrie replied, "what I don't understand is why are we being charged. You see groups of tourists and other people everyday in front of Parliament. Why are they all not charged?"

All the defendants then asked that Mr Yap Keng Ho be tried separately as he was not part of the Tak Boleh Tahan campaign. Mr Yap made the same application and wanted to be tried separately.

The judge dismissed the application and insisted that the trial include Mr Yap.

Towards the end of the day, Mr Jeffrey George asked for his trial to be adjourned so that he could return to his contract work. Mr George is a oil-rig engineer.

The judge rejected his application.

"Can I then be excused from the hearing? I give my undertaking that I will abide by all the decisions made by the court."

The judge, too, rejected this application.

In the end, Mr George pleaded guilty as this was the only way for him to get back to his work. He was fined $1,200.

The hearing continues tomorrow at 9:30 am in Subordinate Court 5 before Distrct Judge Chia Wee Kiat.

PS: Mr Ng E-jay was handcuffed while he was escorted to the Registry to pay his fine. Was there a need to cuff him when Mr Ng was clearly not a criminal? Even his lawyer was unhappy that he was treated thus.

    You might wish to know that the police insisted on putting handcuffs on me while I was on the way to pay my $600 fine! LOL!

    Don't spill your food/drinks yet. I tried explaining to those very polite (YES, they were very, very polite to me!) officers that:

    1. I was not on any bail.

    2. I was not a violent criminal (gosh!)

    3. I had already indicated my willingness to be under armed and heavy escort to pay my fine, that I would pay the fine in CASH immediately, yeah, the full $600 of it WHICH WIPES OUT ALL THE GROWTH DIVIDENDS AND GST CREDITS I GOT THIS YEAR! *Cry* *Sob* Booo hooo!

    And yet, they still insisted on the handcuffs, saying it was PROCEDURE! LOL!

    It seems that they cannot get me for anything else, they want to get me on just the last few minutes that I am with them! Even the last few minutes also want to be so petty and vindictive towards me! What procedure?!?!? If it was really procedure, why did the police officer get a phone call INSTRUCTING HIM that it was procedure? If it was procedure, wouldn't he know right from the start??!?! Why did someone have to call him to TELL HIM it was procedure??!!?

    The court, in this case, does not seem to serve the justice but to punish whoever speak out against PAP policies.

    Compare this to the article "Come and support the activists during the trial" which read, "We are proud of being able to come together to defend and push for the rights of our fellow citizens, for without these rights we are at the mercy of the PAP. We know that we are guided by the truth and righteousness."

    If SDP knows it's righteous, why did its activist pleaded guilty in the morning?

    "In the end, Mr George pleaded guilty as this was the only way for him to get back to his work. He was fined $1,200."

    What's more, one of the SDP activists pleaded guilty just to go back to work! Seems like career is more important than political stand.

    The Best Job Insurance: SDP calls out for supporters to donate to its legal defence fund, which will be used to keep Mr George's job.

    With the guilty pleas, SDP has lost its legitimacy among its supporters. This is because SDP has gone back on its civil disobedience action. Remember how Dr Chee claimed to be on hunger strike but secretly drank glucose water?

    Oscar Award for the most illogical statement of the YEAR:

    This either shows the naivity of Mr Jufrie to law, or that he's trying to say the SDP did not campaign at all in front of Parliament. So wasn't there a demonstration?

    In conclusion, SDP doesn't really care about the poor in Singapore as much as they say they are. It protested outside Parliament House but said they were just like tourists walking pass Parliament without intention of demanding more to be done to alleviate poverty in Singapore. All else said, after the bankruptcy of SDP, it could consider joining the Entertainment industry.

    The morning started with Ng E J pleading guilty. Following SDP's philosophy (always infer the worst), we can infer a lot from this. SDP was so proud of the "united" activists, who "one by one stepped up and pleaded not guilty". Apparently, Ng is a lot smarter than the rest of you. SDP chose to simply report the fact, offering no explanation or details of the plead. In his defence, Ng's lawyer said that Ng did not hold any placards, nor did he speak to the press. Hmmm - SDP style translation - "it wasn't me man! Unlike the others, I did not cause trouble" Yeah - one for all, all for one!
    Think Mr Ng did the wise and sensible thing. I hope he finds a more fruitful outlet for his passion and cause. Good luck.

    Fellow citizens without rights are at the mercy of the PAP. SDP activists/citizens without doubt are at the mercy of the PAP. They come in all shapes and sizes. Some have families and jobs to think about.

    Mr Ng E-Jay is a PhD candidate in the NUS. I believe he is doing his thesis now so wont be able to afford the time to be away. While he could spend some time expressing his undeniable rights as a citizen, he does not have weeks for a trial!

    This a what a PAP govt wants from its citizens, work and work and work. Study hard looking for a job...but don't oppose the PAP! It is detrimental to your careers, families or studies. PAP wants to depress salaries with no minimum wages or rights. It fears people taking to the streets like those brave souls wearing TBT t-shirts!

    You and Richard Kong are fools for not recognising that your rights have been taken away! Citizens who stand up for their rights should not be belittled, instead they should be encouraged!

    LKY thought he could secure what he regarded as our national interests by cleverly concocting minute legalities, so as to nip any possible threat to his rule at the bud.

    But he did not have the "helicopter view" to see the flip side of such maneuvres.

    The more minute the legalities, the more trivial the judiciary appears when the process of the law, administered to "play-safe" by sticking to the letter of the law, results in boy-scout type assemblies and "protests" being prosecuted in the name of the "dignity" and "stateliness" of our nation's judiciary.

    All the comic, silly blunders SDP here points out, in the manner the prosecution and judge seem to be handling the matter, only go to show how unaccustomed they are at applying the law, meant for sombre matters, on trivial things.

    Not everyone is willing to make even small sacrifices (or even effort) for people who don't even appreciate what they do, much less bigger ones. How much have you done that you can judge?

    Hi E-jay,

    A friend told me that Jeffrey George was not handcuffed when he was taken to pay his fine. But you were forced into this humiliation despite the fact that you were simply exercising your constitutional rights.

    The friend also told me that you could ask your lawyer to take up the issue of why you were treated differently. There is also the possibility of seeking damages for the humiliation.

    Paying fine does not mean giving up the cause. Both E-jay and Jeffrey are men with strong conviction.

    When the Rules are against SDP and Dr Chee it is very hard for them to mount a coherent campaign. Mr George has to feed his stomach or his family. He has little choice in the matter. It is not easy for one to sit through 18-day trial hearing - that experience can be very trying.
