SDP Assistant Secretary-General, Mr John Tan, was sentenced to 15 days imprisonment by High Court Judge Judith Prakash for wearing a T-shirt emblazoned with a kangaroo in a judge's gown during the defamation hearing between Lee Kuan Yew and the Singapore Democrats.

Fellow activists Mr Shafi'ie and Mr Isrizal were each sentenced to 7 days imprisonment also for wearing the T-shirt. Mr Tan's penalty was heavier because he had handed the T-shirt to the other activists.

All three men were also ordered to pay $5,000 as cost to the Attorney-General.

During the hearing on 24 November, the Attorney General had wanted a harsh punishment for the three because, according to Deputy Solicitor-General Jeffrey Chan, "calling the judicial system a kangaroo court is the worst insult one can hurl against it."

Mr Tan had argued that since the presiding judge had conceded that the judiciary is not beyond criticism, the court should then accept the message conveyed by the T-shirt as fair criticism. The SDP leader explained that the purpose of his action was to point out weaknesses in our judiciary system and had hoped that improvement to the quality of justice would be made.

The arguments, however, did not sit well with Judge Judith Prakash, who found the three men guilty as charged.

In another incident, Mr Gopalan Nair called on SDP's leaders and other human rights advocates after he was released from jail on 20 Nov 08, following his two-month imprisonment for insulting High Court Judge Belinda Ang. Mr Nair bade farewell and the SDP wished him well and a safe journey home to the US. He left Singapore yesterday.

The Singapore High Court Thursday sentenced three Singaporeans to seven to 15 days' jail for wearing T-shirts bearing a picture of a kangaroo in judge's robes in the vicinity of the New Supreme Court Building last May.

Muhammad Shafi'ie Syahmi Sariman and Isrizal Mohamed Isa were jailed for seven days each and Tan Liang Joo John, 15 days, by Justice Judith Prakash.

She also ordered each of them to pay the Attorney-General's Chambers S$5,000 in costs and disbursements.

The case against the trio for contempt of court was heard on Monday.

The Attorney-General had applied for contempt proceedings to be instituted against the three after they appeared in the T-shirts in the court which was hearing assessment of damages in respect of a defamation action brought by Minister Mentor Lee Kuan Yew and Prime Minister Lee Hsien Loong against the Singapore Democratic Party (SDP) leaders last May.

The AG's Chambers took offence as it implied that the court was a kangaroo court.

Tan was also heard saying: "This is a kangaroo court" to Lee when the Minister Mentor walked past him outside Court No. 4B at the New Supreme Court Building.

On 27 July this year, an article entitled "Police question activists over kangaroo T-shirts" appeared on the SDP website.

The article reproduced a photograph of the three men wearing the same T-shirts and it was meant to give wider publicity to their allegation that the court was a kangaroo court, the AG had said.

At the Monday hearing, the Attorney-General was represented by Deputy Solicitor-General Jeffrey Chan Wah Teck, principal senior state counsel Jennifer Marie and state counsel Gillian Koh Tan and Lee Jwee Nguan.

Tan and Isrizal appeared in person while Muhammad Shafi'ie Syahmi was represented by Chia Ti Lik.

After reviewing the evidence from both sides, Justice Prakash found that each of them was in contempt of court in the manner alleged.

In the case of Muhammad Shafi'ie Syahmi and Isrizal, Justice Prakash found that they were in contempt for wearing the T-shirts in the vicinity of the court and inside the courthouse.

In the case of Tan, the judge found him to be in contempt for distributing the T-shirt in the court building and wearing the offending T-shirt and for being involved in the posting of the photograph on the SDP website.

The three men also refused to apologise to the court or to withdraw their insinuation about the Singapore court when given the opportunity to do so by Justice Prakash.

    I wish I was the one wearing them kangaroo tees. I could have asked for a longer sentence, something like 70 days or 7000 days imprisonment. I would then come out and do it over and over again!

    The judgement is not surprising. In principle, I think they ought to appeal.
    I salute these men for their courage. We need effective methods to get fair criticism of the judicial system across to our people.

    If you have to jail someone who wears a "suggestive T-shirt" in order to defend your Honour, you are on thin ice.

    If you have to suppress a small group of peaceful protesters from public demonstration, chances are you can't take the heat.

    If you have to sue media to defend your Honour, chances are your Honour is not as robust as you want it to be.

    The more you try to crush dissenting voices, the more people will suspect you have things to hide.

    Suppose I accuse my department supervisor of a misuse of authority. Does it sound fair to let my supervisor evaluate the merits of my complaint? Obviously no (due to the inherent conflict of interest)!

    But this is precisely happening in our judiciary! [i]The courts are tasked with evaluating whether they are a "kangaroo court"[/i]!

    I hope the three of them can sell their T-shirts in eBay.

    I think LKY's photo to replace the kangaroo will be more appropriate as this will "upgrade" him from a small time lawyer to a judge. You can't sue someone who "upgrade" LKY.

    There was indeed no contempt of court per se but contempt of MMLee who saw the T-shirts while in his official car for an unofficial court case. Perhaps under his direction these people were hurled by the court for contempt of court! And by so doing for charges for contempt of court, the whole world now knows Singapore's "kangaroo" court much better than before! Being highlighted!

    In order to convincingly escape from this virtuous or vicious circle of our own courts punishing those who "insult" our own courts, why don't we do what we did in analogous disputes?

    The dispute with Malaysia over the two rocks, of course, could not be convincingly resolved had it been brought up in either Malaysian or Singapore courts, however independent the judiciaries were claimed to be.

    I remember the years, prior to the London Privy Council's judging the case in favour of the late Jeyaratnam, when Lee Kuan Yew himself took great pride in the Council's being the highest court of appeal in our judiciary system as the ultimate test of its independence and reliability.

    Quitely rightly; and so, also, our universities achieved "world classed" recognition via appeal to external examiners, and our schools go for external validation at the Cambridge O and A levels, and others.

    So, why not convene a panel of truly international and independently acknowledged experts at law of the political neutrality that would enable them to examine whether or not our courts were "kangaroo"? After all, we have habitually engaged external consultants to advise on almost every major national project, even on casinos.

    What about similar extrnal validation of such an important institution as our judiciary, especially in times when even major world legal organisations and respectable publications have been voicing doubts over it?

    I'm sure the OF (LKY) is not satisfied with the sentences meted out to the 3 bravehearts and has told his son to introduce caning for such kangaroo offences asap.
    I'll take a bet that the AGC has already started draft amendment legislation for mandatory caning for anyone calling our sacrosanct judiciary kangaroos.
    Kangaroo is now a dirty word in S'pore.

    The main function of the judiciary is to carry out justice for the people. Especially in Singapore, many fiascos had happened and were due to the incompetency of the government and yet the local court has not once tried to hold the government accountable by having commissions of inquiry. Egs:
    1. The escape of Mas Selamat. Where is Mas Selamat now?
    2. How much financial losses have GIC and Temasick incurred so far? Are there any damage control plan to mitigate or to improve the dire financial situation?
    3. How the Town Councils lost so much money in the investments?
    4. Why MAS allowed banks to sell high-risk financial products to anybody?

    The list can go on but somehow all these fiascos are swept under the carpet. Instead of going after those people who are responsible for all these fiascos, our judiciary is more interested in putting people in jail for wearing T-shirts with kangaroo pictures.

    What a judiciary? I will wipe my arse and throw at them.

Suppose I decided to potray the judges as the S'pore Merlion(same context as kangaroos), it becomes an offence? Or how about one with PAP? I say to the judge'punish and prosecute', and the next day in the newspaper 'Man charged for wearing PAP T shirt' Or I wear plain T shirt and say to the judge it means his head is empty like the T shirt and I get charged for wearing a plain T shirt. Please lah S'pore court, you are the joke of the nation. I'm gonna spread this news overseas that the S'pore court is run by a bunch of goons and idiots. I'm gonna smear the court's reputation.

Must we subject ourselves to be assessed and reassessed repeatedly whenever the kangaroos lost the case in court? You are a legal expert, do u think any miscarriage of justice?

    I sincerely applaud for the brave actions taken by these 3 Singapore sons and applaud even louder the decision made by our judiciary system by jailing them. We have eyes to see for ourselves who's being right and who's been wronged. Hopefully the government can call for a snap election soon. I await the day Singapore achieve the true democracy which all Singaporeans yearn for as long as time permits.

    It's really astonishing to learn that one of the Australian national mascots (besides Koala Bear)has now become an "offensive" image if applied or implied in any drawing or cartoon depicting a "court or judge".
    As an artist myself, I feel that images of animals can mean different things to different people.Take Mickey Mouse for example.To most,it represents a likeable "hero" image but to draw a
    personality in a caricature of Mickey Mouse may be interpreted as portraying him as "timid as a mouse"? (Especially
    a mouse is regarded by Chinese as even "sneaky").
    So, where should one draw the line?
    Should one be so easily "offended" by a
    mere drawing that can be ambiguious in interpretation?
    It's like the "White Elephant" drawings
    found in Buangkok MRT station,remember?
    How come the Court or the relevant authorities did not "take offence" or "punish" the artists(or the ones who put up the pics)?
    Or simply because the Kangaroo case involved oppositionists?

    Why don't SDP design a new T-shirt that says "Do not wear this T-shirt in Singapore; it could get you in jail" and print the Kangaroo Judge behind, with a URL to explain the details of the court case?

    Sell this to the tourists; it will help spread the word.

    It is totally strange that SDP in its news forum did not mentioned anything about the anti-government protest in Thailand and the heart breaking Terrorist attact in Mumbai which have 1 of our fellow country mate killed.

    Democracy is a double edged sword, when it is taking to the extreme, its result in unstability to the nation and extremism behaviour from the supporters. Though I'm thankful that the SDP supporters had so far did not reached to that extreme end of things but all these so called civil disobedience is truly disturbing and if not control, may result in Singapore falls into the same situation like Bangkok and worst till, like in Mumbai.

    Whoever that dreamt or envision that politic is clean and just, I believe they are living in an unreal world. Politic are about control and power and many a time money. Histroy had shown us so many time that many well intention politician may started well with true democracy in mind and the interest of their citizen at heart, however, once they get into office, they are overcome by power, greed and control that cloud their initial intention and put their people and nation in turmoil. The most recent case being the ex-President of Taiwan and many other.

    SDP in particular Mr Chee and Ms. Chee had been crying to the international scence about the heavy handed approach the ruling party had used against their political foes, the unfair electoral process or the GRC concept. However, let us imagine if the table is turn around now. Assuming SDP is the ruling party, and the PAP is the opposition party. Don't you all think that SDP will also launch policy that is in favor for themselves to stay in power??? And used whatever legal mean to prevent the opposition party to get into power???? Common, let GET REAL!!!!

    Politic is a power game, you can play the game anyway you wish to as long as you do not cause the whole nation to shut donwn or led the people into povety! So SDP, stop projecting that you are the victim because I'm very sure that when you are in power, you will use the same way the PAP is using now to stay in power!!! Let's GET REAL!

    The protest in Bangkok, the PAD objective, on the surface it is for democracy and against corruption of the formal regime. But it is also a well known fact that these so called advocate of democracy are all driven by self interest and financial gain in controling the economy. They are being sponsored by the Thai elites, royalist and military whom had all being at the losing end in the commercial side during the previous regime. As much as the ex-PM may be corrupted, but the true fact is that during the 8 yrs of his leadership, thailand economy was a boom and people's life are good with good income. Now with the so call fight for democracy, these people are bringing the whole nation down the drain. At the end, even if the PAD get into power, the damage to the economy had been done, the common people on the street suffer whereas the leadership of the party may get into politic and some key position where they will get rich.

    Democracy has to be seen as a holistic view and not a narrow one. It is not about someone idea of democracy, but it is the overall goodness of every individual in Singapore that is most matters. Sometime I would really like to ask the SDP whether for the last decade or more, hadn't the country provided all the education you need, the safty environment you need and the mean to provide a decent living for your family??? Aren't these only possible because of an effective, good but may not be perfect government???? Count your blessing mate and GET REAL!!!! There can never be a perfect government because it is run by human, so let count our blessing and work together to make Singapore a better place in an unperfect world.

    I sincerely hope that SDP will make themselves more constructive to the society than to going around doing all these meaningless act of civil disobedience and to work together with the ruling party to make Singapore a safer place to live in.

    SDP has claimed to be the voice of the minority poor which I think is excellent intent. However, it will be very stupid to bring the entire nation down and cause the poor pupulation to increase because of the distruptive action they are taking. I hope that SDP will not become the next PAD of Thailand.

    So I wish the SDP supporters to GET REAL and understand that this is a power game and not get too emotional to it and cause more problem to our nations.

    Get your facts right.

    Mumbai attacks has [i]nothing[/i] to do with democracy. Terrorist attacks can happen [i]anywhere[/i], democratic or not.

    In fact, genocide, extra-judicial killings and torture happens on a daily basis under authoritarian regimes more than they do in States whose Governments are open to accountability.

    Ditto for Thailand. If the Thai people has no power to overturn a corrupt government, there would be oppression and possibly mass killings by their government troops, just as it did in Burma.

    Would you rather live in Thailand or Burma?

    Singaporeans are not stupid. They migrate to freer countries like Australia and USA in droves, not the other way around.

    SDP is merely promoting political and civil rights so that Singaporeans has the power to call their government into accountability. They are looking to build a democratic system, not looking to topple the PAP.

    Comparison to Mumabi attacks is non-sequitur.

    Comparison to Thailand's PAD is just devious.

    Shame on you, if you are a Singaporean.

    And hello? Like in Mumbai? SDP members are not terrorist nutcases who go around killing or bombing people. Being locked up for decades for no reasons under ISA isn't a whole lot better than just losing your life. And who does that? PAP, that's who. SDP members may be a little braver and more willing to stand up for their beliefs than the average guy, but they're basically ordinary people like you and I. They have more in common with the ordinary man than the PAP who live so high up in their ivory towers that they need a telescope to see the ground.

    To get really real, a system of check and balance between parties is needed. Ie. don't let any one party obtain too much power, such as now with the PAP. You're talking as if it's a must to throw out the PAP entirely. Why not just half?

    Well, I'm not SDP, but I'd like to give you my answer anyway. I don't need education that places more emphasis on memorisation and brainwashing than anything else. I don't need an education where most of what I learnt in school isn't even applied to my work after I graduate. Was there some point in wasting two decades of my life memorising stuff for regurgitation in examinations? Education that teaches one to think for themselves or other soft skills would be a far better use of time and resources.

    Safe environment and decent living sure. However, at the rate inflation is increasing, and with our wages and savings not increasing to match, I don't see the "decent living" continuing for much longer. Do you?

    And when people are desperate, they can and will turn to crime, and there goes your safe environment too.

    So it seem that you approve the way how opposition parties or individual in order to achieve their own version of democracy or idealistic vision and bring the entire country to a halt like in BKK. That is what I meant by extremism! It all started with some passionate talks with a small group of passionate people. Nothing wrong with democracy, but do it at whose expenses? Are you the voice of ALL Singaporean??? Singaporean are not stupid unless you think they are, we had made our choice through all of our vote! So no one should think that what SDP's voices are the real voice and the rest are all fool who are all being deceive by the ruling government. In fact, that is what PAD thinks!!! They want to abolish the 1 man 1 vote system (hiding behind the veil of current government alleged corruption), because they felt that the people cannot think for themselves and are all deceive by the government!

    So get real! The people of Singapore had make their choice and had reject ed the political idealism of SDP in the election and the unacceptable behavior of its leadership and supporters.
