Tax havens are not a new phenomenon. They have been around for decades, acting as shelters for wealthy individuals wanting to avoid paying taxes in their home countries. Singapore has gotten in on the business only recently compared to other places.

But since the advent of the financial crisis a few months ago where some western banks have been wiped out and others left on life-support, some governments have hardened their stance towards offshore banking secrecy. As they find themselves bleeding cash, many of these governments are turning to other means to shore up their finances, one of them being to stop tax monies flowing to offshore secret jurisdictions.

The mood changes


In February 2007, a young US Senator co-sponsored a bill with two of his colleagues to stop tax havens from exploiting loopholes in the US tax structure. They rather straightforwardly called the proposed legislation the Stop Tax Haven Abuse Act.

The proposed legislation describes how Offshore Secrecy Jurisdictions, or tax havens, undermine the integrity of the US tax system, robbing the Treasury of more than US$100 billion each year. It aims to "shut down a lot of these abuses." These jurisdictions, the bill claims, "make it nearly impossible for U.S. authorities to gain access to needed information."

At that time, the young senator said about the legislation: “This is a basic issue of fairness and integrity. We need to crack down on individuals and businesses that abuse our tax laws so that those who work hard and play by the rules aren’t disadvantaged.”

ObamaIn November 2008, this senator was elected President of the United States. Now President-elect Barack Obama seems intent to crackdown on international tax havens when he assumes power on 20 January 2009. He is expected to introduce wide-ranging tax-reform laws "within weeks" of taking office that "could end years of financial secrecy that have protected the super-rich and international businesses as they move money from one jurisdiction to another."

The US is not the only country intent on resolving the tax haven problem. In 2005 the European Union adopted the Savings Tax Directive to combat taxes lost to tax havens. European countries like Austria, Luxembourg and, of course, Switzerland have come under pressure to stop their tax haven practices.

The Organisation for Economic Co-operation and Development (OECD) is also hot on the pursuit of tax havens. The OECD lists four factors to determine if a jurisduction is a tax haven or not:

  • Whether the jurisdiction imposes no or only nominal taxes.
  • Whether there is a lack of transparency
  • Whether there are laws or administrative practices that prevent the effective exchange of information for tax purposes with other governments on taxpayers benefiting from the no or nominal taxation.
  • Whether there is an absence of a requirement that the activity be substantial

"The political climate on the issue of tax havens has changed dramatically over the past three months," says Jeffrey Owens, director of the Centre for Tax Policy Administration at the OECD. Owens has spearheaded the organisation's drive to crackdown on international finance secrecy for more than a decade and says that the financial crisis has intensified the attack on havens.


At the G20 summit convened in Washington DC last month, leaders there agreed that the matter of tax shelters "should be vigorously addressed." They pledged to cooperate on international regulation of the financial system which included a promise to work together to "protect themselves against 'noncooperative' offshore tax havens."

They also wanted to impose controls on hedge funds and ratings agencies, and also "force all the world's secrecy and tax havens to cease and desist their resistance to disclosure."

SarkozyMerkelFrench President Nicolas Sarkozy said: "We are in the 21st century and the French view is that we cannot continue into the 21st century with a system established in the 20th century." He wanted more regulation of the international finance -- including tax havens.

Germany's De Spiegel reported Chancellor Angela Merkel as saying: "We want to further develop policies against tax havens and will support France in this during the [EU] presidency," said Merkel. And this was in April 2008 before the financial meltdown.

The international effort seems to be producing results. Last month clients of top Swiss Bank UBS buckled under pressure and agreed to cooperate with the US Inland Revenue Service to pay back taxes evaded in past years. In return, the US tax authorities would grant the offenders amnesty and not proceed with criminal prosecution. It is believed that some 20,000 US citizens have worked with bankers at UBS to avoid paying taxes.

Singapore not far away


As the squeeze on traditional tax shelters like the Isle of Man, Cayman Islands and Switzerland intensify, tax evaders are moving their money to Singapore which many say is one of the last holdouts against the global drive for transparency. While some jurisdictions may be moving towards becoming more transparent (for example Aruba, the Dutch Antilles, the British Virgin Islands, Bermuda) and others have made political commitments to do so (Cayman Islands and the Bahamas), Singapore has been adamant in its non-cooperation.

In fact, as described in Part I, the Singapore Government has played the role of Switizerland's heir apparent to perfection, energetically persuading the wealthy from all over the world to come and park their funds here.

The PAP disavows such a claim. "Singapore is not a tax haven," Foreign Minister George Yeo insists, "We are a low-tax country but not a tax haven. We're an international financial centre so banking secrecy is very important. It is protected by law. But at the same time we do not condone drug money or terrorism money or money laundering -- these are crimes."

Carl LevinBut the world doesn't seem to believe him. US Senator Carl Levin, one of the three co-authors of the Stop Tax Haven Abuse Act, lumped Singapore with the world's leading tax havens. The American lawmaker said of his proposed bill: "In effect, tax havens sell secrecy to attract clients to their shores. They peddle secrecy the way other countries advertise high quality services. That secrecy is used to cloak tax evasion and other misconduct, and it is that offshore secrecy that is targeted in our bill." He identified a list of 34 jurisdictions as tax havens:

Forbes
magazine reported that the OECD had named four countries Austria, Luxembourg, Switzerland and Singapore that were not making sufficient effort to counter tax evasion and still had retained restrictions on access to banking information for tax purposes.

Another report added: "Interestingly enough, Singapore is the jurisdiction that has been favoured by many seeking to remove assets from the European Union and the other nations that signed up to the EU Savings Tax Directive." It warned that Singapore needs to be careful how it pushes the boundaries of secretive banking as "the influence and far reaching authority of the Organisation for Economic Co-operation and Development should never be underestimated."

The EU itself is exerting pressure on Singapore to lift its shield on information on European tax evaders. Germany's foreign minister was in Singapore earlier this year and had a "heated debate" on the subject of tax evasion.

"The subject is being discussed with a certain amount of emotion in Germany, and rightly so," the German minister said at a news conference, "because (European) states are losing substantive assets when large entities avoid being taxed. I trust this is being understood here. In questions of tax law and tax secrecy Singapore and the European Union are not always of the same opinion. About that we unfortunately have to talk about."

Even the chairman of the Swiss Bankers' Association, Mr Urs Roth, is pointing (hypocritical) fingers at Singapore. Comparing his country and ours, Mr Roth noted that Singapore's banking secrecy provisions are even stronger than the ones in Switzerland. He pointed out that while Singapore is not getting as much attention at the moment compared to Switzerland "I would guess that it is a question of time."

Jeffrey Owens of the OECD summed up the matter for Singapore most cogently: "The political climate is changing and I do not think that Singapore is correctly reading the political signs that a change is about to come."


Part III (concluding) of this analysis will discuss how the PAP's move towards turning Singapore into a tax haven has hurt Singaporeans and Singapore's interests.

    This article must be read by all Singaporeans, especially those in the banking insdustry so that they can get ready to pack up.

    So now what Andy Xei wrote was correct...Singapore is a money laundering hub for the corrupt Indonesians.

    Let's wait and see whether LKY and sissy Loong will start suing Any Xei and Dr. Chee...if they don't sue then what they write about are all correct and if they sue then it shows LKY and Sissy Loong have something to hide.

    By next year the USA will be deep into recession. Then we have the exodus of funds...probably a $trillion out of the Singapore based banks, couple with less "spending" tourist and the manufacturing and biotech productions falls to 50% of its previous year level, casinos have just empty tables and slot machines.

    Just picture this, with 200,000 to 300,000 high paid and permanent jos in the financial and manufactuing gone for good. This will affect at least futher 500,000 of the related family members. Wow!

    LHL would then say: " Singaporeans should thank PAP for giving them so many 'past' good years; lets move on. NO one will be left behind".

    He will act on the solution...incease GST to 20% to help the poor!

    For the US it is that simple, if any countries that refuse to co-perate with them in combating tax evation, then they would not renew licences for those banks with their head office in those countires to operate in the USA.

    Thus DBS, OCBC and DBS will be affected.

    Also USA Treasury can stop honouring the bankdrafts from those countries, thus restricting the flow of money. The OECD can do likewise. Their local banks will have to follow.

    Thus all bankdrafts originated from Singapore cannot be cashed out in uSA and western Europe...except Burma.

    “None of these offshore schemes would work,” said Levin, “without the secrecy that prevents U.S. agencies from enforcing our laws. Our bill offers innovative ways to combat offshore secrecy. We can’t let the offshore tax havens hide $100 billion in U.S. tax revenues which are needed to protect our troops, fund health care and education, and meet the other needs of American families.”

    Among other measures, the 68-page bill would:

    ESTABLISH PRESUMPTIONS TO COMBAT OFFSHORE SECRECY by allowing U.S. tax and securities law enforcement to presume that non-publicly traded, offshore corporations and trusts are controlled by the U.S. taxpayers who formed them or sent them assets, unless the taxpayer proves otherwise;

    IMPOSE TOUGHER REQUIREMENTS ON U.S. TAXPAYERS USING OFFSHORE SECRECY JURISDICTIONS by listing 34 jurisdictions which have already been named in IRS court filings as probable locations for U.S. tax evasion;

    AUTHORIZE SPECIAL MEASURES TO STOP OFFSHORE TAX ABUSES by giving Treasury authority to take special measures against foreign jurisdictions and financial institutions that impede U.S. tax enforcement;

    STRENGTHEN DETECTION OF OFFSHORE ACTIVITIES by requiring U.S. financial institutions that open accounts for foreign entities controlled by U.S. clients, open accounts in offshore secrecy jurisdictions for U.S. clients, or establish entities in offshore secrecy jurisdictions for U.S. clients, to report such actions to the IRS;

    CLOSE OFFSHORE TRUST LOOPHOLES by taxing offshore trust income used to buy real estate, artwork and jewelry for U.S. persons, and treating as trust beneficiaries those persons who actually receive offshore trust assets;

    STRENGTHEN PENALTIES on tax shelter promoters by increasing the maximum fine to 150% of their ill-gotten gains, and on corporate insiders who hide offshore stock holdings by increasing the maximum fine on them to $1 million per violation of U.S. securities laws;

    STOP TAX SHELTER PATENTS by prohibiting the U.S. Patent and Trademark Office from issuing patents for “inventions designed to minimize, avoid, defer, or otherwise affect liability for Federal, State, local, or foreign tax”; and

    REQUIRE HEDGE FUNDS AND COMPANY FORMATION AGENTS TO KNOW THEIR OFFSHORE CLIENTS by requiring them to establish anti-money laundering programs like other U.S. financial institutions, under regulations to be issued by the Treasury Department.

    Among all this is the worst for Singapore. No wounder LKY did not want Obama to win. Also that explains why he flew to Hong Kong immediately after his heart operation to meet ex-President Clinton, whose wife will be the Secretary of State.

    He hopes that Clinton would help to soften Obama? Well then he will be wrong, bec. Obama is not the usual type of President. He is man of intergrity bec. he is a "bottom up" man and believes in common sense "fair" politics.

    Moreover USA needs the US $100 billion (no small change) and the back tax owing. If Obama would to "pardon" the tax due more than 3 years, then all the US individual and co-porate depositors will immediately re-divert the money back to the US from Singapore. That would be $billions flowing out of Singapore banks.

    Do the Singapore banks have the ready cash for all these $billions...well then you will see local banks recalling personal and credit card loans from Singaporeans especially for those who just miss a day of minimum payment.

    Solution: More bankruptcy and suicide cases in Singapore then.

    Tax haven = tax evasion = eluding responsibilities = decreasing revenues = minus funds for aids for the disadvantage or a country's supply = one of the seven sins, avarice (greediness)

    Are you saying that bank robbers, drug lords, ransom money gained by kidnappers can stash their stolen/illegal money safely in Singapore too??

    If Singapore government thinks it is important to obtain tax money by increasing whatever they can such as ERP and GST etc, can't PAP think about another countries' ordeal by helping to keep these kind of money??     I do agree with Derek Wong. What is the point of expose any of our financial regulations. What else does Singapore has to compete with in the region? Do we have any natural resources to fall back on if the financial sector collapse? Let's think of Singaporean survival and not destroy any of our lifeline.     Dear Mr Chee and the readers of this blog,

    The internet has given rise to the real power of free speech. Mr Chee as an ex professor would only be too familar to reference his works properly. I believe that some time back there was a case of libel and slander that were proven true. This could have been avoided had proper reference been provided.
    The Western powers be damned! Are we sleeping together with USA now? I am a tried and true Singaporean, i have served in NS, and like many readers or contributors to this blog, i have every right to comment on my country. No one else in this world other than a Singaporean who has pledge allegience to Singapore has the slightest right to comment on the way we do things. If should any one say that we have to bow to international pressure, then he/she is a traitor and should be hung. There can be no doubt if we allow other powers to play a hand in our own politics we will go the way of Iraq. We will see Americian soldiers raping our women and killing our children.
    If Mr Chee and his loyal supporters seek to topple the current PM, then provide an alternative to the situation. I would think that now is a ripe opportunity for Mr Chee to stand up and present to the country his plan to lead out out of this terrible economic situation.
    We have given the current PM a chance to lead and so far it has been a rather weak show. BUT at least he is DOING something. MR Chee so far has not done a single CONSTRUCTIVE thing at all. When times are bad, the citizens of a country must gather together and fight against outside forces who seek to destroy us. All Mr Chee is doing is aiding these foregin powers to crush and bully Singapore. I do not know Me Chee personally, but so far his actions have shown him to be a dishonorable person. While i cannot say i support the current PM, at least he had the decency to go for an election. He had the courage to stand infront of the people to present his policies. We as Singaporeans may not agree to his plans. We might even one day vote him out of office. BUT that would be the choice of the people of Singapore. Not the decision of USA, or EU or any other country for that matter.
    If Mr Chee so thinks my statements are in error then i urge him by action, by deeds and not more words and talk to show to us his mettle. LKY spent little time talking but a lot of time building. For us to enjoy the fact that we can sit comfortably where we are and type our comments, these privellages have been won for us by the actions of the past generation. I am a young Singaporean not yet 30. I have had an education overseas. I have served my country with pride and with honor.     Haven't we bowed to external pressure? WE have, haven't we. WE REDUCED the number of strokes on yankee michael fay, we committed SAF resources (including manpower) to IRAQ just to quote a few.

    It seems like you have understood Dr Chee wrongly the way LKY said that the westeners are trying to-do-us-in?? Dr Chee is asking the help for justice on our judiciary system and human rights NOT asking people to invade us like [b]how PAP is making now, opening the floodgate for foreigners both talent and untalented alike to invade us by stealing our jobs etc etc etc[/b] (including selling illegal things, more prostitutes than ever - human trade centre and also allowing them to buy HDB flats - increasing price)

    You see Glim, you've misunderstood Dr Chee. I hope you will start reading the real history and current news via internet since what the Shit Times has to offer is only limited and bias. Do some research about these to understand why there are so many people who dislike what LKY had done. The history is not easily accessible via normal channel (not in our national library)

    1. How the current US govt is pressurising the European nations to open up their banking secrecry laws?

    2. What "political and legal" actions would the Obama agovt and the European Union take to pressurise the Singapore and Hong Kong govt.?

    3. How many could be laid off in the Singapore financial sectors and the amount of "lost" depopits in the Singapore offshore banking institutions? Would Shenton Way be transformed to a ghost town as a result?

    4. Would the Indonesia jump onto the bankwagon to demand for the release of info of its corrupt citizens' money in Singapore? If the rest of the world follow on then what is left of the Singapore Fiancial Hub...only for the dead hard regime like Burma and N. Korea and other drug lord money?

    5. Compare how much Singapore and Hong Kong stand to lose in this situations about to happen in 2009.

    These questions should be asked by the opposition in parliament and by the people in the town hall questioning sections.
